\n The Nation\u00adal Park Asso\u00adci\u00ada\u00adtion could not pre\u00advail in the inter\u00adim legal pro\u00adtec\u00adtion pro\u00adceed\u00adings with its appli\u00adca\u00adtion before the High\u00ader Admin\u00adis\u00adtra\u00adtive Court Berlin-Bran\u00adden\u00adburg to restore the sus\u00adpen\u00adsive effect of its objec\u00adtion to the deci\u00adsion of the State Office for Rur\u00adal Devel\u00adop\u00adment, Agri\u00adcul\u00adture and Land Reor\u00adga\u00adni\u00adza\u00adtion (LELF) of 11.06.2013. On July 4th, 2013, the asso\u00adci\u00ada\u00adtion filed an objec\u00adtion to the pro\u00advi\u00adsion\u00adal assign\u00adment of own\u00ader\u00adship with\u00adin the scope of the com\u00adpa\u00adny floor reor\u00adga\u00adni\u00adza\u00adtion, but since the State Office had ordered imme\u00addi\u00adate enforce\u00adabil\u00adi\u00adty, it was forced to sub\u00admit an appli\u00adca\u00adtion to the OVG for the sus\u00adpen\u00adsive effect to be estab\u00adlished. With this, he want\u00aded to avert the chaos caused by the land con\u00adsol\u00adi\u00adda\u00adtion author\u00adi\u00adty among the own\u00aders and users of the areas in the Low\u00ader Oder Val\u00adley and to ensure that a fair, sus\u00adtain\u00adable and sen\u00adsi\u00adble land con\u00adsol\u00adi\u00adda\u00adtion is well pre\u00adpared from the start and not car\u00adried out in a rushed manner.<\/p>\n
In its incon\u00adtestable deci\u00adsion, the OVG hard\u00adly dealt with the argu\u00adments that the asso\u00adci\u00ada\u00adtion had put for\u00adward sev\u00ader\u00adal times and com\u00adpre\u00adhen\u00adsive\u00adly in writ\u00ading and did not allow an oral hear\u00ading, not even an oral hear\u00ading, but after a long wait sim\u00adply decid\u00aded based on the file sit\u00adu\u00ada\u00adtion and decid\u00aded on the Con\u00adcen\u00adtrat\u00aded on the ques\u00adtion of rea\u00adson\u00adable\u00adness and the area and val\u00adue ratio for the areas brought in by the club and its com\u00adpen\u00adsa\u00adtion areas. The finan\u00adcial loss is rea\u00adson\u00adable, there is no gross dis\u00adpro\u00adpor\u00adtion between the areas brought in by the asso\u00adci\u00ada\u00adtion and the com\u00adpen\u00adsa\u00adtion areas allo\u00adcat\u00aded to it. All oth\u00ader dis\u00adputes could be set\u00adtled in the main proceedings.<\/p>\n
The asso\u00adci\u00ada\u00adtion does not share the argu\u00adments and jus\u00adti\u00adfi\u00adca\u00adtions of the OVG and con\u00adsid\u00aders them extreme\u00adly ques\u00adtion\u00adable due to con\u00adsti\u00adtu\u00adtion\u00adal and con\u00adsti\u00adtu\u00adtion\u00adal con\u00adsid\u00ader\u00ada\u00adtions, as will be explained else\u00adwhere. The inter\u00adim legal pro\u00adtec\u00adtion pro\u00adce\u00addure is thus over, the pro\u00advi\u00adsion\u00adal pos\u00adses\u00adsion can be car\u00adried out legal\u00adly. The asso\u00adci\u00ada\u00adtion will con\u00adtin\u00adue to assert its argu\u00adments in the main pro\u00adceed\u00adings, in accor\u00addance with its statutes, its man\u00addate and in the inter\u00adests of nature conservation. <\/p>\n
