\n\tThe Min\u00adistry of the Envi\u00adron\u00adment is not enti\u00adtled to an addi\u00adtion\u00adal final proof of use from the Nation\u00adal Park Asso\u00adci\u00ada\u00adtion (18.05.2011)<\/strong><\/p>\n \n\t <\/p>\n \n \u201cThe Min\u00adistry for the Envi\u00adron\u00adment, Health and Con\u00adsumer Pro\u00adtec\u00adtion of the State of Bran\u00adden\u00adburg (MUGV) has again tak\u00aden action against the Asso\u00adci\u00ada\u00adtion of Friends of the Ger\u00adman-Pol\u00adish Euro\u00adpean Nation\u00adal Park Unteres Oder\u00adtal e. V. (club) have to accept a defeat. Ten years after the last fund\u00ading was paid out, the min\u00adistry had request\u00aded a so-called \u201cfinal proof of use\u201d from the asso\u00adci\u00ada\u00adtion in addi\u00adtion to the indi\u00advid\u00adual state\u00adments of use that had long been drawn up by the association.<\/p>\n \n As you can remem\u00adber, the Nation\u00adal Park Asso\u00adci\u00ada\u00adtion received annu\u00adal grant notices and fund\u00ading between 1992 and 1999. Of course \u2014 as required in the fund\u00ading noti\u00adfi\u00adca\u00adtion \u2014 at the end of each fund\u00ading year he cre\u00adat\u00aded a proof of use that was checked and approved by the fund\u00ading agency, i.e. the min\u00adistry. Funds paid too much were repaid by the association.<\/p>\n \n Well, well over a decade lat\u00ader, the min\u00adistry want\u00aded to force the asso\u00adci\u00ada\u00adtion to cre\u00adate a \u201cfinal proof of use\u201d for the entire fund\u00ading peri\u00adod. Due to the alleged urgency, the min\u00adistry ordered imme\u00addi\u00adate enforce\u00adabil\u00adi\u00adty in its deci\u00adsion of Decem\u00adber 22, 2010. How\u00adev\u00ader, in the legal dis\u00adpute, the min\u00adistry was only able to pro\u00advide the court with the nec\u00ades\u00adsary doc\u00adu\u00adments late and incompletely.<\/p>\n \n The asso\u00adci\u00ada\u00adtion had sued against the deci\u00adsion of the min\u00adistry and against the order of imme\u00addi\u00adate enforce\u00adabil\u00adi\u00adty and has now reached the court to \u201crestore the sus\u00adpen\u00adsive effect of the law\u00adsuit\u201d. As a result, he does not have to pre\u00adpare a \u201cfinal use report\u201d for the time being. But already in the pre\u00adlim\u00adi\u00adnary legal pro\u00adtec\u00adtion pro\u00adceed\u00adings, the court made it clear that it does not con\u00adsid\u00ader the jus\u00adti\u00adfi\u00adca\u00adtion giv\u00aden by the min\u00adistry for the deci\u00adsion and the imme\u00addi\u00adate enforce\u00adabil\u00adi\u00adty to be con\u00advinc\u00ading and not very promis\u00ading. Because the case was clear, the court did not even sched\u00adule an oral hear\u00ading, but decid\u00aded on the basis of the files.<\/p>\n \n That should give the min\u00adistry food for thought. It is prob\u00ada\u00adbly bet\u00adter to give up the hope\u00adless legal dis\u00adpute with the club and to begin rea\u00adson\u00adable nego\u00adti\u00ada\u00adtions with them instead of con\u00adced\u00ading fur\u00adther loss\u00ades in court, which is cost\u00adly and time-consuming.<\/p>\n \n As expect\u00aded, the MUGV has lodged a com\u00adplaint with the com\u00adpe\u00adtent high\u00ader admin\u00adis\u00adtra\u00adtive court in Berlin. As usu\u00adal, the min\u00adistry lit\u00adi\u00adgates as an incor\u00adri\u00adgi\u00adble lit\u00adi\u00adga\u00adtor until a fed\u00ader\u00adal court once again cer\u00adti\u00adfies that he has act\u00aded against the law and immoral\u00adi\u00adty.
