\n \u201cAlmost ten years after the order of the land reor\u00adga\u00adni\u00adza\u00adtion for the Unteres Oder\u00adtal Nation\u00adal Park by the Bran\u00adden\u00adburg Min\u00adistry of Agri\u00adcul\u00adture, the respon\u00adsi\u00adble state office for land reor\u00adga\u00adni\u00adza\u00adtion sought a con\u00adver\u00adsa\u00adtion with the largest prop\u00ader\u00adty own\u00ader, the F\u00f6rdervere\u00adin, for the first time on Fri\u00adday, July 17, 2009, and announced that it intends to assign the asso\u00adci\u00ada\u00adtion to Zone I (total reserves). Since the land reor\u00adga\u00adni\u00adza\u00adtion was ordered, the asso\u00adci\u00ada\u00adtion has insist\u00aded on being assigned to Zone II (50% of the nation\u00adal park), as the deci\u00adsion on land reor\u00adga\u00adni\u00adza\u00adtion from 2000 also provides.<\/p>\n
\n Accord\u00ading to this deci\u00adsion, the Nation\u00adal Park com\u00adpa\u00adny, i.e. the Min\u00adistry for Rur\u00adal Devel\u00adop\u00adment, Envi\u00adron\u00adment and Con\u00adsumer Pro\u00adtec\u00adtion (MLUV), would have to instruct itself in Zone I. Only when all pub\u00adlic-sec\u00adtor areas have been exchanged for Zone I can one think of instruct\u00ading the pri\u00advate asso\u00adci\u00ada\u00adtion there as well.<\/p>\n
\n Con\u00adtrary to its own order res\u00ado\u00adlu\u00adtion, how\u00adev\u00ader, it was always the aim of the MLUV not to instruct the asso\u00adci\u00ada\u00adtion in Zone II, as is legal\u00adly required, but instead in Zone I (total reserves).<\/p>\n
\n The asso\u00adci\u00ada\u00adtion will not accept this ille\u00adgal prac\u00adtice, which con\u00adtra\u00addicts the minister\u2019s own order, for the fol\u00adlow\u00ading reasons:<\/p>\n
\n 1. As the own\u00ader of the total reserves, in which use should no longer be pos\u00adsi\u00adble in the future, the asso\u00adci\u00ada\u00adtion no longer has any options for nature con\u00adser\u00adva\u00adtion. How\u00adev\u00ader, he has the inter\u00adest and the com\u00adpe\u00adtence to be able to car\u00adry out species and biotope pro\u00adtec\u00adtion mea\u00adsures on his land in the long term.<\/p>\n
\n 2. Although the asso\u00adci\u00ada\u00adtion has to bear reg\u00adu\u00adlar costs on des\u00adig\u00adnat\u00aded total reserve areas, eg for the water and soil asso\u00adci\u00ada\u00adtion, it can no longer gen\u00ader\u00adate any income. How\u00adev\u00ader, this seems to be exact\u00adly the inten\u00adtion of the MLUV, name\u00adly to with\u00addraw income from the asso\u00adci\u00ada\u00adtion and bur\u00adden it with expens\u00ades, which soon\u00ader or lat\u00ader leads to insolvency.<\/p>\n
\n Con\u00adtrary to what has been promised, the amend\u00aded Bran\u00adden\u00adburg Water Act does not stip\u00adu\u00adlate that an own\u00ader of total reserves is exempt from fees for the water and soil asso\u00adci\u00ada\u00adtion. He may only ask the MLUV to reim\u00adburse the fees paid, which may or may not be grant\u00aded to him in full or in part, depend\u00ading on the cash sit\u00adu\u00ada\u00adtion and the MLUV\u2019s discretion.<\/p>\n
\n 3. The asso\u00adci\u00ada\u00adtion is com\u00admit\u00adted to the polit\u00adi\u00adcal require\u00adment to take half of the nation\u00adal park out of use and leave it to nature. How\u00adev\u00ader, the legal des\u00adig\u00adna\u00adtion of total reser\u00adva\u00adtions is the respon\u00adsi\u00adbil\u00adi\u00adty of the state and not of a pri\u00advate asso\u00adci\u00ada\u00adtion. For this rea\u00adson, as can be read in the admin\u00adis\u00adtra\u00adtive deci\u00adsion, the land itself must take pos\u00adses\u00adsion of the planned total reserves.<\/p>\n
\n How\u00adev\u00ader, it would be more impor\u00adtant to real\u00adize at short notice, first of all, to stop the cost\u00adly and ener\u00adgy-con\u00adsum\u00ading annu\u00adal pump\u00ading of the Fid\u00addi\u00adchow\u00ader Pold\u00ader (10) imme\u00addi\u00adate\u00adly and to leave the inlet and out\u00adlet struc\u00adtures open all year round. The farm\u00aders work\u00ading in the area have already agreed to this pro\u00adce\u00addure in accor\u00addance with the water man\u00adage\u00adment fea\u00adsi\u00adbil\u00adi\u00adty study of the MLUV, if their areas nev\u00ader\u00adthe\u00adless remain eligible.<\/p>\n
\n On the oth\u00ader hand, it will be very dif\u00adfi\u00adcult, as planned by the state, to take around 3,000 hectares of agri\u00adcul\u00adtur\u00adal land from the fund\u00ading frame\u00adwork through the for\u00admal des\u00adig\u00adna\u00adtion as total reserves. For the farms this would mean a loss of sub\u00adsi\u00addies of \u20ac 1\u20131.5 mil\u00adlion per year. If that is to be imple\u00adment\u00aded, the min\u00adistry has to do it itself and not blame a small asso\u00adci\u00ada\u00adtion to accuse it of want\u00adi\u00adng to sup\u00adpress the farms. It does\u00adn\u2019t go together.<\/p>\n
\n The asso\u00adci\u00ada\u00adtion regrets that despite numer\u00adous com\u00adpro\u00admise pro\u00adpos\u00adals on its part, it has not yet come to a nego\u00adti\u00ada\u00adtion result. With\u00adout prej\u00adu\u00addice to the clear legal sit\u00adu\u00ada\u00adtion, he would be will\u00ading to vol\u00adun\u00adtar\u00adi\u00adly take over a con\u00adsid\u00ader\u00adable amount of total reserves as part of an over\u00adall solu\u00adtion to be nego\u00adti\u00adat\u00aded. \n There are already five law\u00adsuits pend\u00ading at the com\u00adpe\u00adtent admin\u00adis\u00adtra\u00adtive court in Pots\u00addam against five rul\u00adings by the MLUV against the asso\u00adci\u00ada\u00adtion. A law\u00adsuit is direct\u00aded against a renewed ban on trans\u00adfer\u00adring the club areas to the Nation\u00adal Park Foun\u00adda\u00adtion. The MLUV had already approved this trans\u00adfer of land, which was planned from the begin\u00adning, in a set\u00adtle\u00adment before the Pots\u00addam Admin\u00adis\u00adtra\u00adtive Court in 2006, but then did not keep its word. The oth\u00ader four dis\u00adputes con\u00adcern the MLUV\u2019s reclaims total\u00ading around \u20ac 1 mil\u00adlion, which the MLUV opened after it had already declared all finan\u00adcial claims against the asso\u00adci\u00ada\u00adtion to have been set\u00adtled in the above com\u00adpar\u00adi\u00adson from 2006.<\/p>\n
\n The asso\u00adci\u00ada\u00adtion can look for\u00adward to the out\u00adcome of the legal dis\u00adputes with great seren\u00adi\u00adty. It is to be expect\u00aded that the state of Bran\u00adden\u00adburg, as in ear\u00adli\u00ader pro\u00adceed\u00adings, will again be cer\u00adti\u00adfied by the courts as hav\u00ading \u201cille\u00adgal and immoral behav\u00adior\u201d in deal\u00ading with strangers. \n But nowhere else do admin\u00adis\u00adtra\u00adtive court pro\u00adceed\u00adings take as long as in Bran\u00adden\u00adburg, so it will cost a lot of time and mon\u00adey. This does not harm the asso\u00adci\u00ada\u00adtion, but it does harm the nature con\u00adser\u00adva\u00adtion of the coun\u00adtry. That is why the asso\u00adci\u00ada\u00adtion hopes for a sen\u00adsi\u00adble nego\u00adti\u00adat\u00aded solu\u00adtion in the inter\u00adests of the mat\u00adter at the lat\u00adest after the upcom\u00ading elections.<\/p>\n
